Terms and Conditions
Effective Date: 22 January 2026 PropSales (trading as PropSales, operated by Cadian Du Plessis in association with Law Real Estate)
1. Introduction These Terms govern your use of the PropSales website (propsales.co.za or similar) and any services provided, including property valuations, marketing advice, and sales facilitation. By accessing the site or requesting services, you agree to these Terms.
2. Services PropSales provides:
- Free initial property valuations and market advice
- Marketing and sales facilitation services (only upon signed mandate)
- Direct communication and updates during the sales process
Services are limited to residential property sales in Randburg, Sandton, and Roodepoort areas.
3. No obligation for initial valuation The free valuation and consultation carry no obligation to list or mandate. You may withdraw at any time before signing a mandate.
4. Mandates and commissions
- Any formal mandate (sole or open) will be documented separately in a written agreement compliant with the Property Practitioners Act.
- Commission is payable only on successful completion of a sale (as per mandate terms).
- No upfront fees are charged for valuation, advice, or marketing prior to mandate.
5. Accuracy of information Valuations are estimates based on available market data and are not guarantees. Market conditions can change. We are not liable for any loss arising from reliance on our advice unless caused by gross negligence.
6. Your responsibilities You warrant that:
- All information provided is accurate and complete
- You are the registered owner or authorised to sell the property
- You will comply with all laws (e.g., compliance certificates, rates clearance)
7. Limitation of liability To the maximum extent permitted by law:
- We are not liable for indirect, consequential, or special damages
- Total liability is limited to the commission received (if any)
- We are not responsible for third-party actions (e.g., buyers, conveyancers)
8. Intellectual property All website content (text, images, logo) is owned by PropSales or licensed. You may not copy, reproduce, or use without permission except for personal reference.
9. Privacy Your personal information is handled in accordance with our Privacy Policy (linked above), which forms part of these Terms.
10. Governing law and jurisdiction These Terms are governed by South African law. Any disputes will be subject to the exclusive jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg.
11. Changes to terms We may update these Terms. Continued use after changes constitutes acceptance.
